Le juge est-il un scientifique ? À lire certaines décisions, le doute est permis. Comment est-il possible d’aboutir à des situations où le droit va frontalement à l’encontre de la science et du consensus scientifique ? Le juge ne doit-il pas trancher en faveur de la vérité ? Face aux réactions épidermiques que peuvent générer certaines affaires, il est temps de se poser et d’échanger sur le rôle du juge, de ses décisions et la place du consensus scientifique dans son travail.
Nous essaierons ensemble de comprendre pourquoi et comment, derrière des décisions d’apparences absurdes se cachent d’authentiques réflexions complexes.

Du fait même de sa construction, nous constatons que le consensus scientifique est le plus haut niveau de preuve possible en science. Nous pourrions penser que c’est donc ce qui est le plus proche de la vérité. Il devrait donc s’imposer logiquement dans un procès comme étant le niveau de preuve ultime. Un obstacle se dresse sur le chemin de cette évidence : les règles de droit. Plongez avec nous et devenez le jury d’un faux procès pour appréhender par vous-même le raisonnement d’un juge ménageant le respect du consensus scientifique et des règles de procédures.
